Terms of Service for The Access App (Project Access)

1. Nature of the Service (Non-Custodial & Zero-Hosting)

The Access app, also known as Project Access ("Access," "the app"), is a "Universal Doorway" and non-custodial payment routing interface operated by SaFire Studio. We provide software that allows digital content creators ("Creators") to generate paywalls and route micro-transactions.

Limited Hosting: The Access app (Project Access) directly hosts creator-authored text and images (e.g., blog-style Access Pass content, cover art, and thumbnails) that creators upload to the platform. Access does not upload, copy, store, or distribute video or audio files — the platform strictly utilizes inline framing (<iframe>) and URL redirection to access video/audio content hosted entirely by third parties (e.g., Facebook, Instagram, TikTok, YouTube, Google Drive, IPFS).

Financial Routing: Access is not a bank. BSV/HandCash transactions are peer-to-peer (P2P), settling instantaneously via the BSV blockchain to the Creator's designated HandCash paymail, and SaFire Studio cannot reverse, claw back, or refund these settled transactions. Credit card / Stripe transactions are different: Access temporarily holds the Creator's proceeds from card-based sales for a 30-day processing and chargeback-protection period before releasing the payout to the Creator's linked payout wallet. Held funds are used solely to facilitate this payout and chargeback window, not for any other purpose.

2. Third-Party Platform Integrations & API Terms

To provide our core content gating functionalities, The Access app (Project Access) integrates with third-party APIs, including Meta API Services (Facebook/Instagram), TikTok API Services, and Google API Services (YouTube).

User Compliance: By connecting your third-party accounts or generating paywall links for content hosted on third-party networks, you explicitly agree to remain in full compliance with the terms and community baselines of those services, including the Meta Platform Terms, Instagram Terms of Use, TikTok Terms of Service, TikTok Community Guidelines, and the YouTube Terms of Service.

Watermark and Branding Restrictions: In accordance with the Developer Policies of these platforms, The Access app (Project Access) strictly guarantees that it will not superimpose, inject, or otherwise include any platform brand names, logos, watermarks, promotional text, or advertising links on or inside any creator content pulled from or shared via their respective APIs. All media parameters are respected exactly as provided by the origin hosting source.

3. Creator Obligations and Intellectual Property

By generating a paywall link via The Access app (Project Access), you, the Creator, represent and warrant that:

• You are the sole and exclusive owner of the digital content linked to the platform, or you have obtained all necessary licenses, clearances, and permissions to monetize it.
• Your linked content does not violate any third-party intellectual property rights, rights of privacy, or rights of publicity.
• You bear sole legal and financial responsibility for the content at the destination URL.

4. Account Suspension & Blacklisting

SaFire Studio reserves the right to instantly and permanently terminate your access to the platform, revoke active session_tokens, and blacklist your associated user_id and HandCash paymail if you violate these Terms, including the monetization of unauthorized or stolen intellectual property, or if your underlying source channels violate third-party community guidelines resulting in platform-level strikes.

5. Limitation of Liability

To the maximum extent permitted by applicable law, SaFire Studio, its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or digital assets, resulting from:

• The uninterrupted availability of third-party hosting platforms (e.g., Meta downtime, TikTok downtime, YouTube downtime, API schema modifications, or account de-authorizations).
• Network latency, failures, or irreversible transactions on the blockchain.
• The unauthorized use of your intellectual property by third parties.

6. Creator Payout Wallets & Forfeiture

Creators are solely responsible for maintaining a valid payout wallet (HandCash handle or BSV address) linked to their account. The Access app (Project Access) routes all content sale payments through the platform treasury before forwarding the creator's share.

• No Wallet = No Payout: If a creator does not have a payout wallet linked at the time of a sale, the creator's share of that transaction will be retained by Access. The creator will not receive payment for that sale.
• Published Content Without a Wallet: If a creator removes their payout wallet while content remains published, that content will continue to be available for purchase. All revenue from such sales will be retained by the platform until the creator links a new wallet. Earnings from sales that occurred while no wallet was linked are not retroactively paid out.
• Relinking a Wallet: Creators may link a new payout wallet at any time. Once linked, future sales will be routed to the new wallet. This does not apply retroactively to past transactions settled without a wallet.
• Wallet Removal with Live Content: Creators will be warned before removing a wallet if they have published content. Proceeding acknowledges that all future earnings will be forfeited to Access until a new wallet is linked.

7. Governing Law and Dispute Resolution

These Terms and any action related thereto will be governed by the laws of the State of Idaho without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action will be the state and federal courts located in Ada County, Idaho.
